Introduction to The Healthscope Fraud
This web site exposes how Healthscope Ltd and its subsidiary, Healthscope Functional Pathology, have been systematically defrauding patients, treating them with contempt, and causing doctors serious conflict of interests.
Healthscope Functional Pathology was previously known as Analytical Reference Laboratories, ARL Pathology and ARL Functional Pathology.
Healthscope Functional Pathology offers specialised "functional pathology" tests by means of test kits that are sent to patients and, after collection of samples, returned to Healthscope Functional Pathology for testing.
I have found that the pathology reports for these Healthscope Functional Pathology tests have no scientific integrity, and are not worth the paper they are printed on.
All of my claims are fully supported by evidence that is available on this site.

What I Discovered
I have discovered the following unlawful and unethical activities of Healthscope Functional Pathology and Healthscope Ltd:

Systematic defrauding of patients because many tests are not conducted in their laboratory and, as a result of inadequate quality control and sample mishandling, have no scientific integrity

Treating patients who ask questions about the scientific integrity of their tests with contempt
-
Causing doctors to have serious conflict of interests by providing "financial support" to doctors professional organizations, and forming associations with medical clinics
My Allegations of Fraud
I claim that Healthscope Functional Pathology and Healthscope Ltd have been defrauding their patients by making fraudulent misrepresentations regarding their "functional pathology" tests..
According to The CCH Macquarie Dictionary of Law, reference G01, fraudulent misrepresentation is defined as:
fraudulent misrepresentation a false representation made knowingly or recklessly as to whether it is true or not, with the intention that it be acted upon, and resulting in damage to the person acting upon it.

This is the definition that I am using here.
I claim that the actions of Healthscope Functional Pathology and Healthscope Ltd are fraudulent because:

Healthscope Functional Pathology and Healthscope Ltd make false representations about their "functional pathology" tests, knowing them to be false or recklessly not knowing whether they are true or false, and with the intention that their patients will be deceived by them and will act upon them.

As a patient of Healthscope, I acted upon the false representations of Healthscope Functional Pathology and Healthscope Ltd, and have suffered damage as a consequence.

Many other patients of Healthscope, will have acted upon the false representations of Healthscope Functional Pathology and Healthscope Ltd , and are likely to have suffered damage as a consequence.
What The Legislation Says
The fraudulent conduct of Healthscope Functional Pathology and Healthscope Ltd is unlawful, according to the Competition and Consumer Act 2010, reference G03:
18 Misleading or deceptive conduct
(1) A person must not, in trade or commerce, engage in conduct that is
misleading or deceptive or is likely to mislead or deceive.

Before 01 January 2011, this fraudulent conduct of Healthscope Functional Pathology and Healthscope Ltd was unlawful according to the Trade Practices Act 1974, reference G04:
52 Misleading or deceptive conduct
(1) A corporation shall not, in trade or commerce, engage in conduct
that is misleading or deceptive or is likely to mislead or deceive.
